something https:copyright ability with
something https:respect to derivatives.
something https:So I get questions like this.
something https:What makes something truly
something https:original versus derivative?
something https:We take so much from so
something https:many sources and develop
something https:our ideas from that.
something https:Another version of that
something https:is there are thousands of
something https:books on leadership and
something https:all of them do not have
something https:super original ideas.
something https:Is each book a
something https:copyrighted original?
something https:And so, I talk in depth
something https:about the original.
something https:and the originality standard
something https:in the prior episode, but
something https:briefly, the confusion when
something https:we use the term, original
something https:is that we think like, I'm
something https:an original and that means
something https:you're, absolutely unique
something https:and innovative and novel.
something https:And when we're talking about.
something https:originality in terms of
something https:copyright protection.
something https:It simply means that it
something https:was independently created
something https:that it is not copied.
something https:it is not that it is the
something https:most mind blowing original
something https:novel that anyone's ever
something https:expressed, but that it
something https:was independently created.
something https:And so.
something https:When we compare original
something https:versus derivative, think about
something https:derivative, on the other hand,
something https:is one of the rights that
something https:we have as copyright owners.
something https:So, briefly, when we are
something https:copyright owners, we have
something https:the exclusive rights to make
something https:copies, to distribute the
something https:work, to publicly perform the
something https:work, to publicly display the
something https:work, and to create derivative
something https:works from that work.
something https:creating derivative works
something https:is an exclusive right
something https:of the copyright owner.
something https:And so that's where this
something https:question comes from, can I be
something https:influenced by somebody else's
something https:work without, tripping into
something https:it being a derivative work?
something https:Just to get it out of the
something https:way, because I know you're
something https:all asking about it, I will
something https:start by having a brief
something https:conversation about fair use.
something https:So fair use is a legal
something https:doctrine that allows
something https:the limited use of
something https:copyrighted material
something https:without needing permission
something https:from the copyright owner.
something https:Remember, copyright ownership
something https:gives us exclusive rights.
something https:That means if somebody
something https:wants to do something
something https:with my copyrighted
something https:work, then they have to
something https:get permission from me.
something https:But fair use says there
something https:are limited circumstances
something https:where they can use your work
something https:without your permission.
something https:So basically, typically,
something https:and all these things are
something https:going to be generalizations.
something https:Of course, there's always
something https:going to be, fact specifics.
something https:But generally, when you're
something https:using fair use, you're taking
something https:that original work and you
something https:are, using it somehow, like,
something https:in commentary or, in, teaching
something https:or in education or research.
something https:and so it's not
something https:transformative nature of
something https:creating something new.
something https:It's about kind of taking.
something https:Your copyrighted work,
something https:some or all of it and using
something https:it, in a way that adding
something https:it to my thing in whole.
something https:So what we need to think
something https:about with fair use is that
something https:fair use is not a license.
something https:Because we're doing it
something https:without a license that is
something https:by definition, we are using
something https:that work without a license.
something https:So what it is, is it is a
something https:defense against a copyright
something https:infringement claim.
something https:So when we are relying on
something https:fair use, we are saying,
something https:I am going to use your
something https:copyrighted work without
something https:permission, because I think
something https:it falls under this exception
something https:to require permission.
something https:And that's all great.
something https:Unless you're the copyright
something https:owner disagrees with you.
something https:And chances are, if you
something https:hear from them, that means
something https:they disagree with you.
something https:They're not, checking in with
something https:you just to tell you what a
something https:brilliant job you did, maybe,
something https:but probably they're checking
something https:in with you because, hey.
something https:that's my work.
something https:You didn't ask me for
something https:permission and either, they
something https:want you to stop doing it
something https:or they want to be paid
something https:for it or maybe both.
something https:the only way to assert
something https:your fair use defense
something https:is in court, right?
something https:Cause that's what
something https:a defense is.
something https:So it is, coming
something https:back and saying.
something https:You're right.
something https:I used it.
something https:I didn't get permission,
something https:but I'm not infringing
something https:your copyright.
something https:And this is why and
something https:that is fact specific.
something https:And that means that you
something https:need to make your case
something https:that it is a fair use.
something https:People will ask, you know,
something https:well, is there a percentage?
something https:Is it 5 percent or 10%?
something https:And there's not
something https:a formula for it.
something https:Courts have consistently
something https:refused to say
something https:there's a formula.
something https:They have a framework for
something https:the court who's listening
something https:to it, to your case.
something https:To evaluate your facts, but
something https:they do not have a formula
something https:that you plug in and say,
something https:okay, I only took 1 page
something https:out of a 300 page novel.
something https:So it's 1, 300 and
something https:therefore it's for us.
something https:It's not, it could be the most
something https:important, maybe it's like
something https:the resolution of the entire.
something https:novel that you've taken
something https:like, is that fair use?
something https:Right?
something https:And so, fair use is user
something https:beware because there is no
something https:guarantee that you'll win.
something https:And even if you do, you've
something https:expended a fair amount of
something https:resources to get there.
something https:All right, so enough
something https:about fair use.
something https:I don't like fair use.
something https:So let's talk about
something https:derivative works.
something https:So again, a derivative work
something https:is a new original work that
something https:includes aspects of a pre
something https:existing copyrighted work.
something https:to create a derivative
something https:work, you need permission
something https:of the copyright.
something https:Holder.
something https:Remember the right to
something https:create derivative work is
something https:an exclusive right held
something https:by the copyright owner.
something https:So you need to get
something https:that right from the
something https:copyright owner, right?
something https:And so derivative works
something https:include things like sequels or
something https:adaptations or translations.
something https:So something where
something https:you're taking.
something https:That original work pre
something https:existing copyrighted work,
something https:like a book, and you are
something https:adding some new elements
something https:to it, like a new language
something https:or making it a sequel or
something https:turning a book into a movie,
something https:and so that new work, the
something https:derivative work is also
something https:eligible for copyright
something https:protection, except if you
something https:don't have the right to use To
something https:create that derivative work.
something https:I don't care how original
something https:what you did like you create
something https:a sequel to Harry Potter.
something https:I don't care how
something https:original it is.
something https:If you don't have permission
something https:to create that sequel, then
something https:even the original parts
something https:of that are not eligible
something https:for copyright protection.
something https:All right.
something https:So, just to compare fair use.
something https:Versus derivative use, you
something https:know, that fair use is kind
something https:of taking some portion.
something https:I'm taking some portion
something https:of the Harry Potter book,
something https:and I'm putting it into
something https:some sort of, slide show
something https:that I'm creating, or I am
something https:having commentary about, the
something https:portrayal of, people with
something https:glasses in popular culture,
something https:or something versus taking.
something https:Harry Potter and
something https:creating a new work
something https:based on Harry Potter.
something https:All right.
something https:So if we get back to that
something https:question, what makes something
something https:original versus derivative?
something https:Well, that isn't the
something https:right question to ask.
something https:And for a couple of reasons,
something https:one, it suggests that there is
something https:some kind of continuum between
something https:original and derivative.
something https:Like we started, once and it's
something https:For me on the left, because I
something https:go left to right is something
something https:completely original right with
something https:not copying or using any 3rd
something https:party material of any kind.
something https:we kind of go and yeah, we
something https:corporate a little bit that
something https:I got from someone else.
something https:So it's mostly original.
something https:I'm having a
something https:little bit or it's.
something https:my idea, but I've
something https:incorporated some stuff
something https:from some other people.
something https:So it's, a little
something https:less original.
something https:Right.
something https:And then at some point, as
something https:I continue to incorporate
something https:somebody else's stuff, it
something https:flips over into derivative
something https:and it doesn't work like that.
something https:copying is very.
something https:Binary.
something https:So either it's
something https:original or it's not.
something https:So if you've copied anything
something https:from somebody else and by
something https:copying, I literally mean
something https:copying, then it doesn't
something https:matter how small it is.
something https:It's not original.
something https:And derivative is a
something https:separate right under
something https:copyright law than copying.
something https:Remember copying is its
something https:own standalone, right?
something https:Under copyright law and
something https:creating derivative works
something https:is its own standalone
something https:right under copyright law.
something https:If it were the same thing,
something https:there would be two of them.
something https:They're different.
something https:And so someone can create
something https:a derivative without
something https:actually copying anything.
something https:So, let's take Harry Potter.
something https:If I don't copy a single word
something https:out of a, Rowling's, book.
something https:But I...
something https:create a novel that is
something https:based on a, boy wizard who,
something https:fought an evil Lord and
something https:survived, death as an infant.
something https:but I've not copied
something https:anything from the novel.
something https:And I create a new
something https:series based on that.
something https:I have, infringed on her
something https:JK Rawlings right to create
something https:derivative works based on
something https:her Harry Potter novels, even
something https:though I have not literally
something https:copied any part of her novel.
something https:this is where it gets tricky,
something https:which is, are we taking an
something https:idea which is permissible?
something https:We cannot copyright ideas.
something https:Versus have we taken so
something https:much of an idea that is
something https:unique, like a boy wizard
something https:he was almost killed as an
something https:infant who defeats a Lord.
something https:And created something
something https:that trips us into
something https:being a derivative.
something https:And so there is a continuum
something https:there, not between how much
something https:is copied and how much is
something https:derivative, but there's
something https:a continuum between the
something https:nature of the idea that
something https:you're taking and whether
something https:or not you're using it to
something https:create a derivative from it.
something https:I think it's
something https:fairly easy to see.
something https:Please let me know if it's
something https:not, when we look at literary
something https:fiction example, like Harry
something https:Potter versus what we do
something https:and what we do every day.
something https:And so, when we are influenced
something https:and create our expertise,
something https:you know, we are taking
something https:in ideas all the time
something https:and we are incorporating
something https:them into our work.
something https:We are improving upon them.
something https:We are seeing them
something https:from new ways.
something https:We're writing about it.
something https:there's not align.
something https:There's not a bright line
something https:where it's idea idea idea.
something https:I'm taking an idea idea and
something https:then it becomes a derivative.
something https:So that's what's kind of,
something https:that it depends part so
something https:much of legal analysis.
something https:That it really does depend
something https:on the circumstances.
something https:So the question about
something https:leadership books, for
something https:instance, there are a lot
something https:of leadership books and
something https:there are lots of generic
something https:leadership skills that we
something https:learn throughout our careers.
something https:And so if we're talking about,
something https:you the way to build culture
something https:and, you to lead by example
something https:and reward the behaviors you
something https:want to see and things like
something https:that that are considered
something https:generally Generic leadership
something https:skills, and for me to write
something https:about that, even though I
something https:read it in somebody else's
something https:book is without copying, but
something https:taking the ideas about how
something https:to build leadership skills
something https:is working with an idea,
something https:but let's say someone has.
something https:Written about, some very
something https:innovative, very distinctive
something https:leadership skills that
something https:everyone immediately knows.
something https:I wish I had a good example
something https:a real life example of
something https:someone who does something
something https:radically different in order
something https:to, create leadership skills.
something https:and I can't even say,
something https:like, going out in
something https:wilderness things.
something https:I know that the people who
something https:do that, but someone who does
something https:something radically different.
something https:Now, for you to take that
something https:idea, even though you
something https:don't copy the words from
something https:their book, but you take
something https:their radically different
something https:way of teaching leadership
something https:skills and you use them to
something https:create your own training
something https:program, that starts to
something https:look like a derivative work.
something https:And I say it looks like
something https:it because it really would
something https:need more analysis to know
something https:exactly whether or not you
something https:create a derivative work.
something https:And, to make an analogy
something https:that maybe will help
something https:also drive this home.
something https:if we think about, sent
something https:a fair in literature.
something https:it is a French term that
something https:refers to the situations,
something https:characters, settings, or
something https:incidents that are standard
something https:or customary in a particular
something https:genre, and therefore
something https:they aren't protectable.
something https:So, scenes d'affaires
something https:are not protectable
something https:under copyright law.
something https:So examples of that would be,
something https:in a vampire movie, that the
something https:vampire sleeps in a casket and
something https:they can't go out during the
something https:day and they don't eat garlic
something https:or are afraid of garlic.
something https:Those aren't protectable
something https:elements, but if you have
something https:a vampire who, travels to
something https:the dark side of the moon
something https:or to get away from the
something https:sun, that is not even that
something https:would not qualify as a
something https:sense of air and it would
something https:be protectable that concept.
something https:Even if you don't, copy
something https:the words from that novel,
something https:but if you take the concept
something https:of a vampire that travels
something https:to the dark side of the
something https:moon, Maybe there's a lot
something https:of books out there with
something https:that, but, you it may be
something https:that would be derivative.
something https:Right?
something https:And so it is nuanced.
something https:There is not a bright line
something https:like fair use something
something https:you're taking 1 of these
something https:non literary features.
something https:Like, you're not literally
something https:copying, but you're using.
something https:some distinctive and
something https:protectable elements of the
something https:original work and so that
something https:people would identify your
something https:work with the other work.
something https:someone mentioned
something https:this that if.
something https:a normal person read your
something https:work and they assumed that
something https:it was based on some other
something https:known person's work, then
something https:probably it is a derivative.
something https:that is just if we
something https:wanted to have some
something https:kind of really rough.
something https:Test that would be like, would
something https:it just kind of the ordinary
something https:person go, Oh, this must
something https:be, based on, Harry Potter,
something https:because this kid's got, a
something https:lightning scar on his head.
something https:All right, that is the best
something https:we can do without looking at
something https:the specific circumstances.
something https:that brings us to,
something https:okay, how do I.
something https:Navigate, the fact that
something https:I'm out here in the world
something https:consuming information
something https:from all over the place.
something https:And I'd like to leave
something https:you with what we call the
something https:golden rule of copyrights
something https:And that is if you
something https:didn't create it.
something https:Then you don't own it
something https:and you can't use it
something https:without permission.
something https:And so that is kind of
something https:the fundamental principle
something https:of copyright law, which
something https:is to protect the rights
something https:of the creators, that the
something https:right that the creator
something https:has over their original
something https:work, it grants exclusive
something https:rights to the creator.
something https:when we are in the
something https:expertise-based business.
something https:our inventory is copyrighted
something https:works generally when we
something https:are creating deliverables
something https:for our clients.
something https:Generally that is a
something https:copyrighted work when we
something https:are delivering a program,
something https:you know, a training, that's
something https:generally a copyrighted work.
something https:Typically.
something https:what work trade is, is the
something https:delivery of copyrighted works.
something https:so I'll call that
something https:our inventory.
something https:When when we create
something https:inventory, that means we
something https:need raw materials, right?
something https:We need to get in order
something https:to create inventory.
something https:We need raw materials.
something https:And some of that will
something https:come from us from just our
something https:experiences in the world, from
something https:the certifications that we've
something https:received that, maybe a prior
something https:job and some things that we
something https:read some books that we read
something https:some courses that we took.
something https:And those are all things
something https:that are raw materials in
something https:creating our inventory, but
something https:all of those things when
something https:we are experts are also
something https:copyrighted works being.
something https:That is somebody else's
something https:property when we are
something https:taking, parts of somebody's,
something https:course, or parts of
something https:somebody's book or, parts
something https:of somebody else's training.
something https:And so we should no longer.
something https:Expect to receive for free
something https:the raw materials to create
something https:our inventory than a car
something https:manufacturer would expect
something https:to receive for free the raw
something https:materials to create their
something https:inventory, which is cars
something https:just because our inventory
something https:is intellectual and the raw
something https:materials are intellectual
something https:does not mean it isn't a real.
something https:Asset with value with
something https:a owner who has a right
something https:to be paid for it.
something https:So that would be the golden
something https:rule of copyrights and that
something https:is mutual when we build a
something https:culture of, the golden rule
something https:of copyright, people are
something https:respecting your rights as
something https:a creator and you respect
something https:their rights as a creator.
something https:And so, not that I think
something https:that anyone is doing
something https:anything, they're trying
something https:to intentionally infringe
something https:on anyone's copyright.
something https:But this is where we get into
something https:that unintentional copyright
something https:infringement territory when
something https:we are trying to parse, what
something https:percentage is somebody's
something https:material I can use to you.
