Episode 213: When Does a Podcast Become a TV Show?

A show starts as audio only, adds video shot remotely from home, and then the production company builds out an entire television studio around it — airing on a major streamer's platform alongside YouTube and podcast feeds. In this episode, Gordon Firemark, The Podcast Lawyer™, tackles a real, current question from his own practice: how should hosts negotiate TV-level compensation and terms as their show's production scales past what a typical podcast contract ever anticipated?

The "what is a podcast" debate. Audio purists still see podcasting as fundamentally an audio medium, but YouTube, Spotify, and Apple now all treat video as a first-class podcast format. That shift makes the format question more than philosophical — it has real financial and legal consequences.

Signals of crossing the line. Multi-camera production, a dedicated crew, and a real production budget are one signal. Platform-level distribution and promotion — treated like flagship television content rather than one show among thousands — is the other. The combination is what matters most.

Timing and leverage. The best moment to renegotiate is before committing to a new season, and leverage is often highest right after a production company has invested heavily in a studio build-out.

What to negotiate. Compensation structure benchmarked against comparable TV/streaming talent work (including performance-based terms), travel and per diem provisions for studio days, classification and benefits appropriate to on-air talent, and whether union or guild jurisdiction could apply.
